THE HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU I.A.Nos.1 and 2 of 2018 in/and APPEAL SUIT No.717 of 2011 JUDGMENT:
I.A.No.2 of 2018 is filed to permit the power of attorney holder to represent and sign the compromise on behalf of his father Sri Suresh Joshi. Original power of attorney executed before notary on 10.8.2018 is filed.
The application is, therefore, allowed and the deponent is permitted to represent the petitioner.
Both the learned counsel, appellant and the General Power of Attorney holder of the 1st respondent are present. They have filed photostat copies of Aadhar Card in proof of their identity which are countersigned by the counsel. Both the parties agreed that compromise has been effected with their own free will and volition and there is no force or compulsion in terms of the compromise.
Hence, I.A.No.1 of 2018 is ordered and the compromise is recorded as prayed for. The signed compromise memo will form a part of the judgment and decree whenever a copy of the same is given to them.
Accordingly, the appeal suit is disposed of in terms of the compromise. No order as to costs.
