THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.664 of 2016 ORDER:

The grievance of the petitioner was that the police authorities were not taking action upon her complaint dated 30.12.2015. Consequential direction was sought to the Station House Officer, Madhapur Police Station, to register a FIR on the said complaint and take appropriate action in accordance with law. Written instructions dated 20.01.2016 were furnished by the Sub-Inspector of Police, Madhapur Police Station, Cyberabad, to the office of the learned Government Pleader for Home stating that the petitioner had not given any complaint at Madhapur Police Station either on 30.12.2015 or any other subsequent date. He therefore asserted that the question of registering a FIR and conducting investigation did not arise.

Faced with this situation, Sri P.R.K. Amarendra Kumar, learned counsel for the petitioner, fairly stated that his client would approach the police authorities with a fresh complaint, if warranted. Needless to state, in the event any such complaint is made by the petitioner, the police authorities would be bound to act in accordance with the directions of the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 1st February, 2016 IBL
