ORDER :

This Criminal Petition is filed by the Petitioner under Section 482 Cr.P.C seeking to quash the order dated 07.06.2015 passed in Crl.P.M.P. No.514 of 2013 in C.C. No.417 of 2011 on the file of Judicial First Class Magistrate, Prathipadu.

2) Heard learned counsel for the petitioner and 1st respondent -State before admission and before ordering notice to 2nd respondentde facto complainant. Perused the material on record.

3) As the petition relied as infructuous by subsequent judgment of learned Magistrate, Prathipadu in C.C. No.417 of 2011 dated 23.04.2015 to refund of Rs.1,00,000/- in deposit made by the petitioner, who is a third party to the Criminal Case being owner of the custody, Crl.P.M.P. No.1744 of 2011, to be reinstated to him after expiry of appeal time and since the appeal time of three months expired, he can file a check petition and take back the amount by approaching the learned Magistrate.

4) Accordingly, the Criminal Petition is disposed of.
