THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.31872 of 2011 ORDER:
The grievance of the petitioners in this case was that the police authorities were harassing them by calling them to the police station and insisting upon their refunding the advance amount received by them under agreement of sale dated 19.08.2011 from one Banka Samson.
Though a counter-affidavit was filed by the Sub-Inspector of Police, Kavali II Town Police Station, SPSR Nellore District, in December 2011, the learned Assistant Government Pleader for Home was asked to get instructions as to the present status. Thereupon, written instructions dated 27.07.2015 were furnished by the SubInspector of Police, Kavali II Town Police Station, SPSR Nellore District, affirming the contents of the counter-affidavit already filed. A conspectus of the same would reveal that one Navuru Venkata Rao lodged a complaint with the Kavali II Town Police Station that one Banka Jeevan and one Banka Samson collected a huge amount of money from the poor public and particularly those residing in SC/ST colonies apart from handicapped persons by promising that they would pay them six times the amount within six months.
Upon the said complaint, Crime No.77 of 2011 was registered under Sections 406, 420 and 120-B I.P.C., read with Section 5 of the Andhra Pradesh Protection of Depositors and Financial Establishment Act, 1999, on the file of Kavali II Town Police Station. During the investigation, the police found that the accused persons paid a part of the amount received to the petitioners for purchase of their land.
the petitioners so as to enquire into the matter. He further stated that investigation in the case was thereafter transferred to the C.I.D. The Sub-Inspector of Police denied the allegation of the petitioners that the police authorities harassed them by insisting upon refund of the advance amount received by them under the agreement of sale dated 19.08.2011. He categorically stated that the police authorities never harassed, threatened or interfered with the life and liberty of the petitioners at any point of time.
The aforestated stand of the police authorities is taken on record.
In the light thereof, no interference is warranted in the present writ petition. The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
