THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3221 OF 2015 ORDER:
The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the docket order, dated 16.11.2015 passed in Crl.M.P.No.1647 of 2015 in crime No.154 of 2015 by the Judicial Magistrate of First Class, at Atmakur, whereby the learned Judge directed the petitioner herein to submit original registration certificate of the vehicle and shall also execute a bond for Rs.5,00,000/- with one surety for the likesum to the satisfaction of the Court concerned and shall also furnish bank guarantee for a sum of Rs.1,00,000/- apart from bond and surety. Heard and perused the material available on record. Learned counsel for the petitioner submits that the petitioner herein is ready to produce the original registration certificate of the vehicle in question and as such, the question of submitting the personal bond and bank guarantee does not arise.
Considering the facts and circumstances of the case, the order impugned to the extent of the petitioner submitting the personal bond and furnishing the bank guarantee is hereby set aside. The Court below is directed to release the vehicle in question to the petitioner herein on his submitting the original registration certificate to the Court concerned and on further condition that the petitioner would not change or alter the physical features of the vehicle in question and that he would produce the vehicle in question whenever it is directed to produce the said vehicle.
With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
