This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the order dated 25.07.2016, passed in Crl.M.P.No.1256 of 2016 in C.C.No.189 of 2015 on the file of Judicial Magistrate of First Class, Special Mobile Court, Kurnool.

Heard and perused the material available on record. The grievance of the petitioner/complainant is that during the trial of above C.C.No.189 of 2015, she filed petition in Crl.M.P.No.1256 of 2016 under Section 311 of Cr.P.C., to reopen the evidence of DW-1 and recall DW-1 for further cross-examination. This petition is filed admittedly when the matter is posted for judgment. The learned Magistrate has rejected the said petition since the matter is posted for judgment and having done so, he has disposed of the main C.C. In that view of the matter, this petition is disposed of, giving liberty to the petitioner to agitate such of the grievances which she has got and which are in accordance with law, before the appellate Court at the stage of appeal. Accordingly, the Criminal Petition is disposed of. Consequently, pending miscellaneous applications, if any, shall stand closed. __________________ M.S.K.JAISWAL, J 7th September 2016 ajr
