THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.7888 OF 2017 ORDER:
This Writ Petition is filed alleging that the claim of the petitioner is not considered for promotion as Lineman Driver, even though he is eligible and suitable and alleges that another person, who is not eligible for such appointment, is being considered and in such an event, grave prejudice would cause to the petitioner. 2.
As seen from the averments made in support of the Writ Petition and the material papers enclosed thereof, as of now no steps are taken to fill the post of Lineman Driver. The cause of action would arise to the petitioner only in case he is ignored illegally, though he is eligible and suitable and another person, who is not eligible or does not have preferential claim as compared to the petitioner, is appointed. Thus, as of now, the claim of the petitioner is premature. This Court is not inclined to entertain the Writ Petition.

At this stage, learned counsel for the petitioner submits that ventilating his grievance, the petitioner be given liberty to submit appropriate representation for consideration to the competent authority.

Having regard to the said submission, without expressing any opinion on the merits of the case, the Writ Petition is dismissed giving liberty to the petitioner to submit a representation before the competent authority ventilating his grievance. It is needless to observe that as and when such representation is
submitted by the petitioner, the same shall be considered and appropriate decision be taken by the competent authority, as warranted by law by assigning due reasons as expeditiously as possible and decision be communicated to the petitioner. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
