Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise for the respondents. 2.

According to the petitioner, the second respondent issued a licence bearing No.17-175/2017-19, dated 30.06.2017, in favour of the petitioner for A-4 shop for the period commencing from 01.07.2017 to 30.06.2019. Thereafter, the second respondent, by way of notice bearing Rc.No165/2017/A4, dated 08.08.2017, asked the petitioner to submit shifting proposals of the said shop on the ground that there was a public agitation. Thereafter, the petitioner submitted a representation on 16.08.2017 to the second respondent, indicating the new premises i.e., slab house of M.Appala Raju, Market Road, near: Shivaji Statute, within Salur Municipality limits. The grievance of the petitioner is that despite submitting the said representation, no action has been taken by the second respondent. 3.

Despite granting time, the respondents did not furnish any instructions to this Court. This Court, having regard to the facts and circumstances of this case, does not find any justification on the part of the respondents in not responding to the representation of the petitioner dated 16.08.2017.

Hence, the writ petition is allowed, directing the second respondent to take appropriate action on the representation dated 16.08.2016 submitted by the petitioner, within a period of one week from the date of receipt of a copy of this order. Consequently,

miscellaneous petitions pending, if any, shall stand dismissed. There shall be no order as to costs.
