Gavadagatla Venkateswarlu, Prakasam Dist. And 6 Others v. V. Vinay Chand, Prakasam Dist.
HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.2069 OF 2017 O R D E R :
This contempt case is filed alleging violation of order dated 07-04-2017 passed in WP.No.12210 of 2017, wherein this Court directed to consider the representation of the petitioner dated 15-03-2017 after issuing notice to the petitioners as well as 5th respondent.
Counter affidavit is filed stating that in pursuance to the orders in the writ petition, the 2nd respondent passed orders in Rc.E26993 (E2), dated 18-10-2017. As such, there is no violation of orders passed by this Court. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Assignment.
A perusal of the order dated 18-10-2017 passed by the 2nd respondent goes to show that notices were issued to both the parties and the said order is passed. More so, the order in the writ petition is to dispose of the representation. Though learned counsel for the petitioner tried to argue the case on merits and tried to assail the correctness of the order. But I do not see any reason to say that there is violation of orders passed by this Court.
In view of the same, the contempt case is dismissed. However, it is open for the petitioner to challenge the proceedings dated 18-10-2017 in accordance with law.
As a sequel thereto, miscellaneous applications, if any, pending in this case, shall stand closed.
