ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A20 seeking to quash the proceedings in S.C.No.122 of 2016 on the file of IV Additional Metropolitan Sessions Judge, Nampally, Hyderabad, registered for the offences punishable under Sections 147, 148, 302 r/w 149 IPC and u/s.27(3) of Arms Act, 1959, against him.

2. It is alleged in the complaint that on 24.12.2012 at about 7.30 PM., while the nephew of de facto complainant, by name Nawaz, was eating pani puri along with his friend, A1 to A24 armed with deadly weapons, attacked his nephew and stabbed him with knives due to previous enmity and thereafter, he succumbed to the injuries while undergoing treatment. Based on the complaint, the aforesaid crime was registered against A1 to A24.

3. Heard and perused the material on record.

4. Since there are serious allegations mentioned in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings. At this stage, learned counsel for the petitioner confined his argument to the extent that the presence of the petitioner/A20 before the trial Court may be dispensed with. In view of the same, the presence of the petitioner/A20 before the trial Court is dispensed with except on the dates whenever his presence is

insisted by the trial Court and he shall be represented by his counsel.

5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed. _______________ RAJA ELANGO, J 28th April, 2016 sj
