HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26843 of 2017 ORDER:
The inaction of respondent Nos.2 and 3, in investigating into FIR No.607 of 2015, is questioned in this Writ Petition as being illegal and arbitrary.
Learned Government Pleader for Home (TS), on instructions, would submit that, after completion of investigation, and after obtaining permission from the Assistant Commissioner of Police, Madhapur Division, a final report, under Section 173 of the Criminal Procedure Code, 1973 (Cr.P.C), was filed in the Court of XXV Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad. A copy of the final report has been placed before this Court. Since the final report has been filed, the cause in the Writ Petition does not survive necessitating adjudication by this Court. Leaving it open to the petitioner to avail his remedies under the Cr.P.C., the Writ Petition is dismissed. Miscellaneous Petition pending, if any, shall also stand dismissed.
