ORDER:
This contempt case is filed alleging willful disobedience of order, dated 05.12.2014, in W.P.M.P.No.38541 of in W.P.No.30833 of 2014.
Though there was stiff resistance from the contemnor for granting renewal of the petitioner's saw mill license on the ground of pendency of the writ petition, eventually, he has seen reason and agreed to renew the license, inter alia, subject to the outcome of W.P.No.30833 of 2014. Accordingly, the contemnor has placed before the Court, proceedings in Rc.No.2744/N6/2007, dated 01.08.2015, wherein he has granted temporary license up to 31.12.2015.
Mr.M.Dhananjaya Reddy, learned counsel for the petitioner, pointed out that as per the extant rules, the contemnor is empowered to renew the license up to a period of three years, and submitted that as his client has paid renewal fee along with penalty for three years, the action of the respondent limiting renewal up to 31.12.2015 is arbitrary. The contemnor, who is present in the Court, agreed that he will revise the order, dated 01.08.2015, by granting renewal for a period of three years i.e., up to 31.12.2017 subject to the outcome of W.P.No.30833 of 2014.
As the contemnor has eventually purged the contempt, the Contempt Case is closed by placing on record the oral undertaking given by him that the renewal of the petitioner's saw mill license will be issued up to 31.12.2017 subject to the outcome of W.P.No.30833 of 2014 and without prejudice to the plea of the petitioner in the pending writ petition that it is not liable to pay penalty which it has already paid. As a sequel to closing of the Contempt Case, Contempt Application No.424 of 2015 filed by the petitioner for interim relief shall stand dismissed as infructuous.
