THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19812 of 2019 ORDER:

In this Writ Petition, grievance of petitioner is non-consideration of representation dated 21.06.2019 submitted by it with respect to non-implementation of layout plan vide File No.C/1649/2014/W vide ROC.No.G1/1158/2015 dated 17.04.2015 pertaining to the housing colony constructed in the land admeasuring Acs.41.33 guntas in Survey No.49 of erstwhile Dhamsalapuram Revenue Village, under the limits of Khammam Municipal Corporation, in its letter and spirit. It is to be noted that it is the duty of the municipal authorities to implement the layout plan in its letter and spirit, particularly, by projecting the common areas, which have been earmarked for public purpose in a sanctioned layout. In those circumstances, the seventh respondent - Khammam Municipal Corporation, represented by its Commissioner at Khammam, is directed to take into consideration the complaint made by the petitioner on 21.06.2019 and take necessary steps by duly following the procedure prescribed. It is needless to mention that before passing any order, the seventh respondent shall verify the allegations of the

CKR, J W.P.No.19812 of 2019 petitioner and if such allegations are found to be proved, it shall issue notice to the eighth respondent, who is alleged to have occupied the open areas, with respect to non-implementation of the alleged layout in its letter and spirit.
