This Petition coming on for hearing,upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri P NARASIMHULU ,Advocate for the Petitioner and the Assistant Public Prosecutor on behalf of the Respondent No. 1 and NONE for the Respondent No.2.

THE HONOURABLE SRT JUSTICE K.LAKSHMAN CRIMINAL PETITION No.S3OO OF 2022 ORDER:

This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is fi1ed seeking to quash the proceedings in C.C.No.348 of 2022, pending on the hle of II AJCJ-Cum-X Additional Metropolitan Courts, Kukatpally, Ranga Reddy District. The petitioners herein are accused Nos.4 and 5 in the said crime. The offences alleged against them are under Sections 498-4 of IPC and Sections 3 and 4 of Dowry Prohibition Act, I96I .

2. Heard the learned counsel for the petitioners and I learned Assistant Public Prosecutor for the respondent-State. Perused the record 3.

As per the contents of the charge sheet in C.C.No.348 of 2022, the marriage of A-1 with the 2na respondent was performed on 24.IO.2OI3. Thereafter, matrimonial disputes arose between them. Accused No.1 filed HMOP No. 142 of 201,6 on the ground of cruelty and the same is pending. The petitioners herein are maternal Uncle and Aunt of A-1. In matrimonial disputes, identification of parties

is not in dispute. The punishment prescribed for the offences alleged against the petitioners herein is beiow seven years. 4.

In view of the above discussion, this Criminal Petition is disposed of dispensing with the presence of the petitioners herein/A-4 and A-5 in C.C.No.348 of 2022, pending on the file of II AJCJ-Cum-X Additional Metropolitan Courts, Kukatpally, Ranga Reddy District. However, they shall appear before the said Court as and when their presence is required.

Miscellaneous Petitions, if any, pending, shall also stand closed.
