THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Appeal Nos.855 and 858 of 2016 and Writ Petition Nos.28042 and 29692 of 2016 COMMON JUDGMENT: (Per Hon'ble the Acting Chief Justice Ramesh Ranganathan) Learned Advocate General for the State of Andhra Pradesh submits that certain amendments have been made to the Andhra Pradesh Infrastructure Development Enabling Act, 2001, and consequently the Government has decided to withdraw the request for proposal, which is impugned in these Writ Petitions, and to issue a request for proposal afresh.
As both the appeals are preferred against the interlocutory orders passed by the learned Single Judge and as the very basis, on which the Writ Petitions came to be filed, no longer exists, both Sri D.Prakash Reddy and Sri V.Venkata Ramana, learned Senior Counsel appearing on behalf of the petitioners, and the learned Advocate General for the State of Andhra Pradesh, would agree that the Writ Petitions be closed leaving all questions raised therein open for examination, if need be, in appropriate legal proceedings.
As counsel on either side are in agreement that the cause in the Writ Petitions do not survive, the Writ Petitions are closed leaving all questions raised therein open to be canvassed, if need be, in appropriate legal proceedings. Both the Writ Appeals are disposed of accordingly. No order as to costs.
Consequently, miscellaneous petitions, if any, pending both in the Writ Appeals and in the Writ Petitions shall also stand closed.
