THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.24894 OF 2015 ORDER:

This Writ Petition is filed seeking relief against the respondent in not considering his representations dated 23.6.2015 and 20.7.2015 for making a correction of his date of birth in his passport.

Mrs. Shiva Kumari, learned counsel appearing for the respondent submits that filing of representations before the authorities is not sufficient for changing his date of birth. The petitioner needs to file an application in the prescribed form as indicated in the passport rules along with requisite fee while enclosing all the relevant documents and information. Since the same is not done by the petitioner, his claim was not considered. In any event, if the petitioner submits an application in the prescribed form complying with all the required formalities, necessary action will be taken within four weeks and the same will be communicated to the petitioner.

In view of the facts and circumstances of this case, this Writ Petition is disposed of giving liberty to the petitioner to make an application before the concerned authorities in accordance with the passport Act and Rules and the same would be considered by the respondent authorities within a period of four weeks from the date of making such an application.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
