THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION NOs.34221, 34279, 34286, 34287, 34292, 34333, 34392 AND 34410 OF 2015 COMMON ORDER:

In all these eight Writ Petitions, the grievance of the petitioners is common that they are not supplied with essential commodities and that their authorization is subsisting and they are entitled to run their respective fair price shops. It is stated that the respondents envisaged to fill up vacancies to appoint regular fair price shop dealers and had issued notification dated 01.01.2015 covering all the vacancies. However, a batch of Writ Petitions were filed in W.P.No.59 of 2015 and batch questioning the notification dated 01.01.2015 and by order of this Court dated 04.09.2015, the said batch of Writ Petitions were allowed setting aside the notification impugned in the batch of Writ Petitions while giving liberty to the respondents to issue fresh notification as per Roster Register submitted to this Court in respect of Kadapa and Ananthapur revenue divisions. Some of the present petitioners are petitioners in the said batch of Writ Petitions. However, the common grievance of the petitioners is non-supply and allotment of essential commodities to their respective fair price shops.

Learned Government Pleader for Civil Supplies was asked to get instructions and on the basis of the written instructions, he submits that most of the petitioners are working as temporary fair price shop dealers but in view of the vacancies notified in the notification referred to above, which was however set aside by this Court in a batch of Writ Petitions, the Revenue Divisional Officer, Kadapa, in implementation of the said orders, has already stated to have issued instructions on 16.10.2015 for allotment and supply of essential commodities to the writ petitioners. In view of the said specific instructions of the learned Government Pleader in each of these cases, the order of this Court is stated to have been implemented and consequently, each petitioner is entitled to supply of the essential commodities, as long as their authorization remains valid and subsisting. Since appropriate orders are already stated to have been issued to provide essential commodities to the

petitioners, no further directions are called for in these Writ Petitions. All the eight Writ Petitions are disposed of, accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending in these eight Writ Petitions shall stand closed.
