Heard learned counsel for the petitioner, and the learned Standing Counsel for GHMC.

It is the grievance of the petitioner that he is the owner of Plot No.321/ E situated at Road No.25, Jubilee Hills, Hyderabad, and he has also constructed a house and also a compound wall on the Western side. The respondent authorities are threatening to demolish the same without there being any notice issued to the petitioner.

On the other hand, Sri L. Venkateswara Rao, learned Standing Counsel, submits that the allegation that the respondent authorities have threatened to demolish is false, and taking into consideration that there is some encroachment by the petitioner in Butterfly Park, the petitioner was directed to submit the documents with respect to his claim along with the sketch plan, and instead of submitting the same, the petitioner approached this Court. Learned Standing Counsel submits that without considering the documents that may be submitted by the petitioner, no action would be taken.

In those circumstances, liberty is given to the petitioner to submit the documents sought by the respondent authorities. Thereafter, on examining the same, if the respondent authorities find that there is encroachment on the part of the petitioner, they shall issue appropriate notice calling for explanation, and after considering the explanation that may be submitted, the authorities shall take necessary action, in accordance with law, to ensure that there is no encroachment in the Park area.
