HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.39386 of 2015 ORDER:

The petitioner, who is appellant in Appeal No.2485/2014, which is stated to be pending before the 3rd respondent, filed the present writ alleging inaction in considering the said appeal. The appeal is stated to have been filed in the year 2014. However, the petitioner alleges that no date of hearing is fixed and seeks early disposal of the said appeal.

Heard the learned Government Pleader for Revenue and the learned Standing Counsel appearing for the 5th respondent. In view of pendency of the appeal for a long time, it is appropriate to direct the 3rd respondent to fix an early date of hearing, hear the parties and decide the appeal on its own merits, expeditiously preferably within two months from the date of receipt of a copy of this order.
