THE HON'BLE SRI JUSTICE S.V.BHATT Writ Petition No.24885 of 2009 ORDER :

Sri T.Balaji, learned counsel for the petitioner, requests the Court to permit the Writ Petitioner to avail the remedy of appeal under Cooperative Societies Act and requests the Court to pass appropriate orders giving liberty as prayed for. It is not in dispute that the grievance, if any, of the petitioner ought to be worked out within the framework of the Cooperative Societies Act.

As the existence of remedy of appeal is admitted by the learned counsel appearing for parties, the Writ Petition is disposed of by giving liberty as prayed for. As and when an appeal is filed by the petitioner, the Tribunal takes note of the time spent by the petitioner in prosecuting the Writ remedy under Article 226 of the Constitution of India. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
