O R D E R
The grievance of the petitioner herein was that the police authorities were colluding with respondents 4 to 7 herein and failed to take action upon the complaint
dated 13.09.2011 made by the petitioner.
The Inspector of Police, Badvel, Kadapa District, filed a counter-affidavit stating that upon the petitioner's complaint dated 13.09.2011, Crime No.37 of 2011 had been registered on the file of the Badvel Police Station under Sections 323, 448, 506 and 509 read with Section 34 IPC along with Crime No.156 of 2011 under Sections 323, 448 and 506 read with Section 34 IPC. Upon a cross complaint said to have been made by one K. Sarojamma, Crime No.157 of 2011 was registered against the petitioner under Sections 323, 506 and 509 read with Section 34 IPC. The Inspector further stated that the matter was under enquiry and necessary action would be taken as deemed fit.
No reply affidavit was filed rebutting the above counter-affidavit averments. In the light of the statements made by the Inspector of Police, Badvel, it is clear that the allegation of the petitioner that the police authorities were colluding with the private respondents and were inactive upon the petitioner's complaint dated 13.09.2011 is factually incorrect. The police authorities seem to have registered not one but two cases on the basis of the petitioner's complaint, viz., Crime Nos.37 of 2011 and 156 of 2011 on the file of the Badvel police station. The writ petition is therefore without merit and is accordingly dismissed. Pending miscellaneous petitions shall also stand dismissed.
