ORDER: (Per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The petitioner has filed the present habeas corpus petition, inter alia on the ground that her son, Mohd.Ahmed, was picked up by the SHO, Task Force (South Zone), the respondent No.3, on 09.09.2019, and ever since then, he has gone missing. 2.
However, Mr.S.Santosh Kumar, the learned counsel for the State, submits that on 06.09.2019, F.I.R.No.160 of 2019 was registered at Police Station, Veldurthi for an offence under Section 395 IPC. In connection with the said F.I.R., the petitioner's son has been picked up by the police in Andhra Pradesh. Subsequently, he was produced before the Judicial Magistrate on 12.09.2019. Ever since then, he has been lodged in Sub-Jail, Kurnool. Therefore, his custody is not an illegal one. 3.
Considering the fact that the petitioner's son has been arrested in connection with F.I.R.No.160 of 2019, considering the fact that he has been remanded to judicial custody by the Judicial Magistrate, the custody of the petitioner's son is not an illegal one. Thus, this Court does not find any merit in the writ petition; it is, hereby, dismissed. There shall be no order as to costs.
