This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.4 seeking anticipatory bail in crime No.71 of 2015 on the file of the Sodam Police Station, Chittoor District, registered for the offences under Sections 302, 306 read with Section 34 IPC and subsequently, the section of law was altered to Sections 384 and 420 IPC.
Heard and perused.
The case of the prosecution is that unable to pay the debts to the petitioner and other accused, the de facto complainant's son and daughter-in-law had thrown their son and daughter in the tank bund and thereafter they also jumped in the tank bund and thereby committed suicide.
Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is a law abiding citizen. He further submits that the co-accused was arrested and released on bail and as such prays this Court to grant anticipatory bail to the petitioner herein. Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner herein. It is left open to the petitioner to surrender and file an application seeking regular bail.
