Balla Padmavathi v. State Of A.P.
HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.1669 of 2016 Date:21.01.2016 Between:
Balla Padmavathi, W/o Balla Tarakeshu ..... Petitioner And:
State of A.P., reptd by its Principal Secretary, Panchayat Raj & Rural Development, Hyderabad and five others.
.....Respondents Counsel for the Petitioner: Mr. K.Manik Prabhu Counsel for Respondent Nos.1, 2 & 4: AGP for Panchayat Raj (AP) The Court made the following:
ORDER:
The petitioner, who is the Sarpanch of Zinkibhadra Gram Panchayat, Sompeta Mandal, Srikakulam District, filed this Writ Petition with the grievance that though several works were executed by her in pursuance of the resolutions passed by the said Gram Panchayat, respondent Nos.5 and 6 have not been entering the works in the Measurement books and honouring the bills being submitted by her. The further grievance of the petitioner is that the representations made to respondent No.3 have also not yielded any positive result. After hearing the learned counsel for all the
parties, this Court is of the opinion that it is appropriate that respondent No.4 addresses the grievance of the petitioner and redress the same if he is satisfied that the works were duly sanctioned by the Gram Panchayat and executed by the petitioner.
Accordingly, the petitioner is permitted to make a representation before respondent No.4 along with the relevant material in support of her plea that as Sarpanch of the above-mentioned Gram Panchayat, she has executed the works sanctioned by the Gram Panchayat. Within two months of receipt of such representation, respondent No.4 shall hold an enquiry after notice to the petitioner and respondent Nos.5 and 6 and pass an appropriate order. If respondent No.4 is satisfied that the petitioner has executed the works following due procedure, he shall direct respondent Nos.5 and 6 to enter the same in the records and payments are duly made to the petitioner.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.2096 of 2016 shall stand disposed of as infructuous.
