HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.19869 of 2019 ORDER:

This Writ Petition is filed for the following relief: "...issue Writ order or direction more in the nature Writ of Mandamus declaring the action of respondent Nos.2 to 4 in depriving the petitioner's right to travel abroad on account of pendency of criminal cases in FIR No.7/2017 dt 05/05/2017 on the file of the CBI, BS & FC, Bangalore and FIR.No.8/2019 dt 27/07/2019 on the file of the CBI, BS & FB, Bangalore, as unconstitutional, illegal, arbitrary and without authority and consequently direct the respondents not to restrict the petitioner from travelling abroad and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

Learned counsel for the petitioner submitted that in similar circumstances, this Court allowed Writ Petition No.10116 of 2019, directing the respondents therein to permit the petitioner therein to travel abroad subject to certain conditions and hence, he prays to pass a similar order in this case.

Learned Standing Counsel for the Central Bureau of Investigation has not disputed about the aforesaid order passed by this Court, but, however states that since the quantum of amount involved in the present Writ Petition is huge, the amount of personal bond to be furnished by the petitioner may be fixed at Rs.10 lakhs (Rupees ten lakhs only).

In view of the facts and circumstances of this case and also following the aforesaid order of this Court, the respondents are directed to permit the petitioner to go abroad, i.e., to U.S.A. provided he furnishes a personal bond for a sum of Rs.10 lakhs (Rupees ten

lakhs only) with two sureties for the like sum each to the satisfaction of the Head of the Branch, C.B.I., (BS & FS), Bangalore and also submits his complete travel plans including the addresses where he would be staying abroad during the course of his travel. He is further directed to submit an undertaking by way of an affidavit regarding his travel details, which shall be placed on record. The said affidavit shall be filed well in advance before he intends to travel abroad. A copy of such affidavit shall also be served upon respondent Nos.3 to 6. Subject to the above directions, the Writ Petition is disposed of. As a sequel to the disposal of this petition, Miscellaneous petitions, if any, pending shall stand closed.
