HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No.479 of 2012 JUDGMENT :

This appeal is preferred questioning order dated 27.03.2012 in I.A.No.1388 of 2011 in O.S.No.147 of 2011 on the file of I-Additional District Judge, Karimnagar.

2. Appellant herein filed the above referred suit for recovery of possession and I.A. is filed to restrain defendants from making further construction and that I.A. is dismissed on merits. Questioning the same, present appeal is preferred.

3. Heard both sides.

4. Advocate for appellant submitted that respondents completed construction long back prior to filling of I.A. and appeal can be dispose of directing the trial Court to dispose of suit at an early date.

5. Advocate for respondents submitted that during pendency of I.A., there was no interim order.

6. Considering the submissions of both parties and the fact that there was no interim order through out the case, appeal is dismissed directing the trial Court to dispose of the suit as expeditiously as possible.

7. Miscellaneous petitions pending, if any, shall stand closed. No costs.
