THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.16229 OF 2001 ORDER:

The petitioner, who was the Secretary and Correspondent and Head Master of SSVN Elementary School, Amaravathi, has drawn an amount of Rs.1,61,897/- irregularly from the State Bank of India, Mangalagiri, duly showing the name of Smt.L.B.Lakshmi against aided SGT post of the said school from April, 1992 to Novermber, 1995. It is further stated that the Secretary and Correspondent, RVR College of Education, Guntur, has also certified that said Smt.L.B.Lakshmi is working in the said College since 1984 and receiving salary regularly from the said college and the same was confirmed in the investigation made by the A.C.B. Initially, while admitting the Writ Petition on 07.08.2001, this Court granted interim stay as prayed for. Subsequently, after filing the counter along with vacate stay petition in WVMP No.1412 of 2002, this Court on 03.01.

2003 modified the interim stay order directing the petitioner to deposit the said amount of Rs.1,61,897/- within a period of eight weeks therefrom in any one of the nationalized banks to the credit of the District Educational Officer, Guntur, initially for a period of one year and with a further direction that the same shall not be withdrawn by the District Educational Officer pending final decision in the writ petition. Today, when the matter is taken up for hearing, the learned counsel for the petitioner submits that inspite of addressing several letters, there is no response from the petitioner and the counsel could not contact the petitioner.

Hence, the Writ Petition is closed. However, if the petitioner is aggrieved with any action of the respondents in this regard, he is at liberty to agitate his grievance either before this Court or before any other authority, as per law. The District Educational Officer, Guntur, is at liberty to withdraw the amount deposited, if not already withdrawn.

Miscellaneous petitions pending in this petition, if any, shall stand closed.
