HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT APPEAL No.927 OF 2014 JUDGMENT: (Per Hon'ble The Acting Chief Justice Ramesh Ranganathan) Sri Zakir Ali Danish, learned counsel, appeared on behalf of the appellants-Corporation.
This Appeal, under clause 15 of Letters Patent, is preferred against the order passed by the learned Single Judge in Writ Petition No.11305 of 2011 dated 22.10.2013 wherein the learned Single Judge followed the order passed in W.P. No.2179 of 2006 dated 19.11.2010. In the order in W.P. No.2179 of 2006 dated 19.11.2010, the employees were held entitled for notional regularisation with effect from 06.12.1996. The learned Single Judge has, in the order under appeal, held that the petitioner stands on the same footing as the other employees; and he was entitled to the relief of absorption with effect from 06.12.1996. Against the order passed by the learned Single Judge in W.P. No.2179 of 2006, the Corporation had preferred Writ Appeal No.37 of 2012. The said Writ Appeal, along with W.A. No.
165 of 2015, was disposed of by the common judgment dated 22.04.2015. As the learned Single Judge has merely followed the order in W.P. No.2179 of 2006 dated 19.11.2010 in granting relief to the respondent-writ petitioner and, since W.A. No.37 of 2012, preferred against the order passed in W.P. No.2179 of 2006 was disposed of by judgment dated 22.04.
HACJ & Dr.SA,J WA No.927/2014 accordance with, and in terms of, the judgment of the Division Bench in W.A. No.37 of 2012 dated 22.04.2015.
As a sequel, pending miscellaneous petitions, if any, shall stand dismissed. No order as to costs.
