THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.8475 of 2015 ORDER:

The petitioner claims to be the owner of the land admeasuring 150 square yards in Sy.No.1075/AA of Lingampet Village and Mandal, Nizamabad District. It is his case that respondents 3 and 4 have created false and forged documents and obtained permission for construction of a building in the subject land from the 5th respondent- Gram Panchayat, Lingampet. Aggrieved thereby, he preferred an appeal before the 5th respondent and the same was dismissed vide proceedings No.GPL/09/2014 dated 05.06.2014. Challenging the said proceedings, the petitioner preferred an appeal before the 2nd respondent and the same was numbered as Case No.B5/261/2014-Panchayat. It is the grievance of the petitioner that pursuant to the notice dated 25.06.2014 issued by the 2nd respondent in the said appeal, he appeared before the latter on 30.06.

2014 and submitted all the relevant documents pertaining to the subject property, and though more than nine months have elapsed since then, the 2nd respondent is not disposing of the appeal and taking advantage of the same, respondents 3 and 4 are proceeding with constructions in the subject land. He, therefore, seeks a direction to the 2nd respondent to dispose of the appeal filed by him.

Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Panchayat Raj and the learned Standing Counsel for the 5th respondent.

Having regard to the facts and circumstances of the case and considering the fact that the appeal preferred by the petitioner is pending since more than nine months, the 2nd respondent is directed to dispose of the said appeal in accordance with law within a period of four weeks from the date of receipt of a copy of this order. The writ petition is accordingly disposed of. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
