HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.41639 of 2015 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader appearing for respondent Nos.1 to 4.

The prayer sought in the writ petition is as under: "... to issue a writ or direction more particularly one in the nature of writ of Mandamus by declaring the action of the 3rd respondent in interfering with the civil dispute by and between the petitioners and 5th to 9th respondents herein by intimidating the petitioners to allow the 5th to 9th respondents to enter over the agriculture land in Survey No 341/11 to an extent of Ac.1.10 gts and Sy.No.341/12 to an extent of Ac.1.30 gts and Sy.No.341/13 to an extent of Ac.0.26 gts situated at Eturnagaram village and Mandal, Warangal District for taking possession illegally unlawfully and allow them to erect poles by dividing the land as per the judgment passed in A.S.No 58 of 2010 dated 28.09.2015 which is the subject matter of S.A.No.771 of 2015 as illegal, arbitrary, without jurisdiction and contrary to the Article 14 and 21 of Constitution of India and consequently direct the Respondent No.3 not to interfere with the possession of the agriculture property of the petitioners by extending help to the 5th to 9th Respondents."

Respondent No.4 filed a counter affidavit, wherein it is specifically denied that the respondent police are trying to interfere in the civil disputes between the petitioners and the unofficial respondents. As per the records, no complaint or case of whatsoever is registered against the petitioners on the file of the Eturnagaram Police Station, Warangal. Therefore, the question of summoning of the petitioners to the police station does not arise. Since the dispute between the petitioners and the unofficial respondents is civil in nature, the respondent police are no way concerned with it.

Having regard to the said fact and recording the said submission, this Court is of the opinion that no further orders are required in the writ petition.

Accordingly, the writ petition is closed. No costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 06.12.2018.
