THE HON'BLE SRI JUSTICE MUMMINENI SUDHEER KUMAR WRIT PETITION NO.26551 OF 2022 ORDER:

Heard the learned counsel for the petitioners and learned Government Pleader for Panchayat Raj and Mr. C. Kalyan Rao, learned Standing Counsel, for the respondents. 2.

The petitioners in this Writ Petition are the elected ward members of ward Nos.6 and 5 respectively of the sixth respondent-Gram Panchayat. The grievance of the petitioners is that the Sarpanch of the sixth respondent-Gram Panchayat i.e. the seventh respondent herein is acting contrary to the resolutions passed by the sixth respondent-Gram Panchayat and also misusing the property of the Gram Panchayat and the employees of the Gram Panchayat for his personal purpose and also resorting to misappropriation of sixth respondent's funds indiscriminately. It is also submitted that in spite of the sixth respondent-Gram Panchayat passing several resolutions to take up several works in the Gram Panchayat limits, the seventh respondent herein failed to take any action for implementation of the said resolutions. Aggrieved by the actions of the seventh respondent, the petitioners claim to have submitted representations dated 28.06.2021 and 27.04.2021 to the

MSK,J W.P.NO.26551 OF 2022 respondents 2 and 3 and they have been pursuing the respondents 2 and 3 for the past about one year but no action has been initiated on the representations submitted by the petitioners to the respondents 2 and 3. Hence, learned counsel for the petitioners prays this Court to pass appropriate orders to direct the respondents 2 and 3 to consider the said representations submitted by the petitioners. 3.

Learned Assistant Government Pleader for Panchayat Raj also submitted that inasmuch as the representations submitted by the petitioners are of the year 2021, this Writ Petition may be disposed of directing the respondents 2 and 3 to consider the representations submitted by the petitioners. 4.

In the light of the above, without going into the merits of the case, this Writ Petition is disposed of directing the respondents 2 and 3 to consider the representations dated 28.06.2021 and 27.04.2021 submitted by the petitioners and take action in accordance with law.

In the event, the respondents 2 and 3 intend to take any action against the seventh respondent basing on the representations submitted by the petitioners, the respondents 2 and 3 shall follow due process of law and afford a reasonable
