THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER SECOND APPEAL No.3 6 3 of 2 0 0 0 JUDGMENT:

This Second Appeal, under Section 100 of the Code of Civil Procedure, 1908, is filed by the appellants/ plaintiffs, challenging the judgment, dated 17.01.2000, passed in A.S.No.43 of 1992 by the I Additional District Judge, Krishna, Machilipatnam, whereby, the judgment, dated 12.03.1992, passed in O.S.No.412 of 1987 by the I Additional Junior Civil Judge, Machilipatnam, was confirmed. 2 .

During the course of hearing, the learned counsel for the appellants/ plaintiff would submit that the possession of the plaint schedule property was delivered to the appellants/ plaintiffs five years back, pursuant to the decree passed by the trial Court in the Original Suit and therefore, no cause survives for adjudication in this second appeal.

Recording the said submission, this Second Appeal is dismissed as infructuous. No costs.
