THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.13243 OF 2008 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a Writ in the nature of WRIT OF MANDAMUS or any other appropriate writ or Writs, order or Direction, declaring the Order dt.9-6-2008 passed in IA No.523 of 2008 in Appeal No.A4/LTR/24/2007 on the file of the first respondent herein, as illegal, arbitrary, without jurisdiction and contrary to the order dt.19-4-2008 passed by Hon'ble High Court of Andhra Pradesh in W.P.No.19725 of 2007 and to consequently direct the Respondents to forthwith restore the possession of property admeasuring 25 cents (Sy.No.6-Part) bearing Premises No.6-46/2 and 6-46/3 situated at Asifabad Village and Mandal, Adilabad District to the petitioners herein; Award costs."

After arguing for sometime, learned counsel for the petitioners requested the Court to direct respondent No.1/appellate authority to dispose of Appeal No.A4/LTR/24/2007 pending on its file as expeditiously as possible. 3.

Heard and perused the material available on record. 4.

This Court, by an order, dated 16.07.2008, in W.P.M.P.No.17103 of 2008, directed the appellate authority to dispose of the aforesaid appeal on or before 31.07.2008. Learned counsel for the petitioners submitted that in spite of the said direction, till date, the appeal is not disposed of.

Considering all the facts and circumstances of the case and in view of the fact that as the appeal is pending before the appellate authority, the petitioners can avail the remedy in the said appeal. Hence, respondent No.1/appellate authority is directed to dispose of appeal No.A4/LTR/24/2007 pending on its file on or before 30.12.2017.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
