THE HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.19928 OF 2019 ORDER:
This Writ Petition is filed to declare the inaction of respondents in registration of the crime basing on the complaint dated 24.12.2018 and 27.08.2019 against respondent No.6 and others for illegally trespassing and trying to evict the petitioner from her house.
Heard the learned Counsel for the petitioner and the learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home, on written instructions from the 3rd respondent, submits that a complaint was received from the petitioner through registered post in his office on 27.08.2019 and forwarded the same to the Station House Officer i.e. the 4th respondent with instructions to enquire into the matter and taking necessary action as per law vide C. No.143/19/ACP-BPL dated 28.08.2019. Apart from the complaint, the Station House Officer, Bellampalli-I Town also received another petition dated 27.08.2019 from the petitioner.
By the said instructions, it is stated that after receipt of both the petitions, the 4th respondent made a G.D. entry, secured the presence of both parties and conducted preliminary enquiry. During enquiry it revealed that the above matter is purely related to property dispute and is civil in
nature. Accordingly, a notice was served on the petitioner on 28.08.2019 informing that the matter is related to property dispute and civil in nature and advised the parties to approach the appropriate Court for justice.
Since the learned Counsel for the petitioner on the previous date of hearing on 27.09.2019 submitted that the said communication was not received, a copy of the same was furnished to him.
Inasmuch as the 3rd respondent has issued notice dated 28.08.2019 and the same has been duly received by the petitioner herein, it is open for the petitioner to avail appropriate remedy against the said communication if he feels aggrieved by the same.
Recording the above, this Writ Petition is closed. No order as to costs.
The miscellaneous petitions pending, if any, shall stand closed.
