THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 5316 of 2022 ORDER:

This Criminal Petitions is filed under Sections 437 and 439 of the Criminal Procedure Code by the petitioner/A1 in Crime No.93 of 2022 on the file of Sultanabad/Peddapalli Police Station, Peddapalli District, registered for the offences punishable under Section 409, 420 read with 34 of Indian Penal Code.

The allegation against the petitioner is that he is the partner of Laxminarasimha Rice Mills; that the Civil Supplies Department had given 91,258 Quintals of paddy for custom milling, however, on inspection 21,000 quintals found short, for which reason present complaint was filed by the District Manager, I/c.Civil Supplies Department, alleging misappropriation to that extent which is valued at Rs.5,95,98,278/-. The petitioner is in jail since 09.06.2022. 3.

Learned Counsel for petitioner submits that the entire stocks were not correctly checked and the shortfall which the Department claims is not correct.

However, without going into the said facts, since all the stocks or the deficiencies which were found are matters on record, this petitioner can be granted bail subject to the following conditions. i) The petitioner/A1 shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate at Sultanabad, Peddapalli District.

ii) The petitioner/A1 shall appear before the concerned S.H.O. on every Monday between 10.30 a.m. and 01.00 p.m. for a period of three months or until filing of the charge sheet whichever is earlier, for the purpose of investigation.

iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed. __________________ K.SURENDER, J 30.06.2022 tk
