THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6246 OF 2017 ORDER:

Heard learned counsel for the petitioners and also the learned Public Prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent - defacto complainant and perused the grounds urged in the quash petition to quash the Crime No.134 of 2017 of Husnabad Police Station, registered for the offences punishable under Sections 290, 323, 506 r/w 34 of IPC and Section 3(1)(r)(s) of SC/ST (Prevention of Atrocities) Act, 2015.

The contention of the petitioner that it is a counter blast to Crime No.133 of 2017 of the same police station, registered against the defacto complainant among other, for the offences under Sections 290, 323, 324, 109 r/w 34 IPC. 3.

It is premature for this Court at the nestle stage of the investigation as to which crime is genuine and what offences that attract, to entertain the quash petition or to make any observation touching merits by interfering with the investigation.

Having regard to the above, this criminal petition is disposed of, for nothing to interdict the investigation, but for to say the police strictly follow Section 41A of Cr.P.C., if at all

any arrest is required, as laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
