Dr.K.Karigalan, v. The State Of A.P.
THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.1124 OF 2017 ORDER:
This petition, under Section 482 Cr.PC., is filed by the petitioner/de facto complainant to direct the Judicial Magistrate of First Class, Kuppam, Chittoor District, to dispose of C.C.No.27 of 2016, expeditiously by fixing a prescribed period of time. 2.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor.
3.
Learned counsel for the petitioner would submit that since the number of witnesses to be examined in this case are only eight and having regard to the nature of allegations, the trial court may be directed to dispose of C.C. as expeditiously as possible. 4.
Learned Additional Public Prosecutor opposed the same contending that the C.C is of the year 2016 and having regard to the pendency of the cases in the said Court, it may not be possible to the dispose of the case, more so when the offences are punishable under Sections 420, 465 and 506 read with 34 IPC. 5.
Considering the facts and circumstances of the case, the Criminal Petition is disposed of directing the learned Judicial Magistrate of First Class, Kuppam, Chittoor District, to dispose of C.C.No.27 of 2016, as expeditiously as possible from the date receipt of a copy of this order. Miscellaneous petitions, if any, pending in this petition shall stand closed.
