THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1860 of 2018 ORDER:

This Contempt Case is filed alleging violation of the order dated 01.09.2017 passed by this Court in WP.No.29418/2017 wherein and whereby this Court directed the respondent herei to dispose of the representation of the petitioner dated 01.08.2017. The respondent-Director, Women Development and Child Welfare, filed counter stating that as per the ICDS Norms/guidelines, the power of selection/recruitment of Anganwadi Teachers and Anganwadi Helpers, was delegated to the District Level Selection Committee under the chairmanship of District Collectors; and that the District Welfare Officer, WCD&SC is the Convener, as such, the representation of the petitioner was forwarded to the competent authority i.e.

the District Welfare Officer, Peddapally and in pursuance of the same the respondent herein directed the District Welfare Officer, WCD&SC, Peddapally, vide Memo dated 08.01.2018 to inform the petitioner that due to her unauthorized absence for a period of nine months, termination order was issued after issuing two memos by following the procedure as per rules in force. As per said the directions of the respondent, the District Welfare Officer vide Memo dated 25.08.2018, informed the same to the petitioner.

Heard both sides.

In the writ petition this Court gave only a direction to the respondent herein to consider the representation of the petitioner. In view of the counter affidavit filed by the respondent, it is clear that the representation of the petitioner was referred to the competent authority and order dated 25.08.2018 was passed on the same. In view of the same, I do not see any violation of the orders passed by this Court.

Accordingly, the Contempt Case is closed. However, if the petitioner is aggrieved by the proceedings dated 25.08.2018, it is open for the petitioner to challenge the said proceedings, in accordance with law. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous applications, if any, pending shall stand closed. __________________________ A.RAJASHEKER REDDY, J 27.03.2019 tk
