fca_128_2007 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Family Court Appeal arises out of order and decree dated 11-06-2007 in F.C.O.P.No. 209 of 2006 on the file of the Judge, Family Court, Secunderabad.

Consequent on the reference of the dispute to mediation centre, proceedings of mediation have taken place between the parties. The Deputy Director, Mediation and Arbitration Centre, High Court of Judicature at Hyderabad, has sent his report along with the mediator's report, wherein it is stated as under:

"In pursuance of matter bring referred for mediation, both the parties are present before me for mediation.

Both the parties have settled the issue and are living together since 2008. Hence, both the parties requested to close the proceedings i.e. F.C.A.No. 128 of 2007, in view of settlement."

Sri N.Ashok Kumar, learned counsel for the appellant, and Sri J.Kanakaiah, learned counsel for the respondent, submitted that as the parties are living together, the Family Court Appeal may be disposed of in pursuance of the mediator's report.
