THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13603 OF 2009 ORDER:

This Writ Petition is filed for the following relief: "... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not conducting inquiry pursuant to the charge memo RC.No.C/2472/2006 dated 20.11.2006 and in not passing final orders as illegal, arbitrary, violative of article 14 of the Constitution of India and consequently, direct the 3rd respondent to revoke the suspension of the petitioner pending the inquiry in the charge memo RC.No.C/2472/2006 dated 20.11.2006, pending disposal of the above writ petition, and pass such other order or orders may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner and Sri Ch. Satish Kumar, learned Standing Counsel appearing for the 4th respondent.

Learned counsel for the petitioner states that though charge memo RC.No.C/24722006, dated 20.11.2006, was issued and the petitioner submitted his explanation on 08.08.2008, no orders are passed either dropping or conducting enquiry, and the petitioner is continued under suspension, and as such seeking direction to the respondents to pass orders in pursuant to charge memo as already the petitioner submitted explanation. In view of the above facts and circumstances, the 3rd respondent - Assistant Commissioner, Endowments Department, R.R. District, Hyderabad, is directed to consider the

explanation of the petitioner, dated 08.08.2008, in pursuance of the charge memo RC.No.C/2472/2006, dated 20.11.2006, and pass orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order and thereafter take appropriate action.

Subject to the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed.
