THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34009 OF 2017 ORDER:

The present writ petition is filed seeking a direction to the respondents to operate the petitioner's bus pursuant to the orders of the second respondent dated 01.07.2017. The petitioner, who is in United States of America, is represented by his father and power of attorney holder. The father produced the Registration Certificate with his photo and the Registration Certification was issued in the name of the owner, who is his son. The respondents 3 and 4 raised an objection and sought clarification from the Transport Department as the photo and signatures appearing on the Registration Certificate do not belong to the owner of the vehicle, who is the petitioner herein.

In the circumstances, it is open to the petitioner to obtain necessary certificate from the Transport Department to the effect that the Registration Certificate can be issued with the photograph and signature of the power of attorney holder by showing the name of the original owner. On obtaining such clarification, the petitioner shall produce the same before the respondents 3 and 4 and the respondents 3 and 4 shall consider the same and implement the direction of the second respondent issued on 01.07.2017. At this stage, it is stated by the leaned counsel for the petitioner that the Original Certificate is with the third respondent. If the third respondent is in possession of the Original Registration Certificate, the same shall be handed over to the petitioner's power of attorney holder, who submitted the same to the third respondent.

The writ petition is accordingly disposed of.

Consequently, miscellaneous petitions, if any pending, in the writ petition shall stand closed. There shall be no order as to costs.
