THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7125 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.2 to 4 in Crime No.35 of 2023, on the file of Ganneruvaram Police Station, Karimnagar District, registered for the offences under Sections 306 r/w. 34 of IPC and Section 3 (2) (v) (a) of SC/ST's (POA) Amendment Act, 2015.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioners are accused Nos.2 to 4 seeking relief of regular bail. The complaint was lodged on 17.06.2023 alleging that younger daughter of the de-facto complainant was abducted by these petitioners and others. She was harassed taking her caste name. Unable to bear the said incident, the wife of the de-facto complainant committed suicide by consuming poison.

The abduction was also registered as a crime vide Crime No.33 of by the very same Police, Ganneruvaram, Karimnagar District. In the said case, these petitioners were issued notice under Section 41-A Cr.P.C. The main allegation in the said crime was that A-1 cheated the girl and a case was registered under Section 376 (2) of IPC.

In the present case, the reason for the deceased to commit suicide was on account of the acts of A-1 in committing alleged rape on her. The petitioners are the parents and elder brother of A-1 who are arrayed as accused on the ground of supporting A-1.

The petitioners are in jail since 12.07.2023. As seen from the remand report, most part of the investigation is complete. In the said circumstances, the petitioners can be granted relief of regular bail subject to following conditions:- i) The petitioners/A-2 to A-4 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to the satisfaction of Special Judge for SCs/STs

(POA) Act-Cum-Additional Sessions Judge at Karimnagar.

ii) The petitioners/A-2 to A-4 after release shall appear before the concerned Station House Officer every Monday for a period of eight weeks at 10.00 AM and thereafter as and when required, for the purpose of investigation.

iii) The petitioners/A-2 to A-4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
