This writ petition is filed challenging the action of the respondents in arresting the husbands of the petitioners without following due process of law and issuance of Section 41(A) notice, as illegal and arbitrary and for consequential directions.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for respondents 1 to 5.
Learned counsel for the petitioners submits that against arrest of the petitioners, they have already moved habeas corpus petition. Learned Assistant Government Pleader for respondents submits that since the petitioners have moved habeas corpus petition, the cause in the writ petition does not survive for consideration. Recording the submissions of both the learned counsel, this Writ Petition is disposed of leaving it open to the petitioners to agitate their rights in the habeas corpus petition, which is stated to be filed by them.
