HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11378 of 2015

ORDER

This criminal petition under Sections 437 & 439 of the Code of Criminal Procedure is filed by the petitioners-A1 to A3 seeking to grant bail in connection with Cr.No.52 of 2015 of Chintoor Police Station, East Godavari District, registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of NDPS Act. 2.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor.

3. It is alleged that on 15.09.2015 at 6.00 P.M., near Chidumuru Bridge towards Chetti, Chintoor Mandal, the police officials found the petitioners in possession of 17 Kgs of ganja each, totaling 52 Kgs, in six rexin bags.

Even though it is argued by the learned counsel for the petitioners that each petitioner was in possession of 17Kgs of ganja, which is not a commercial quantity, the total contraband seized from the possession of the accused is 52 Kgs of ganja and it can be precedent that they were in possession of commercial quantity and more so, they are all residents of New Delhi, grant of bail would cause prejudice to the trial before the trial Court. Therefore, this Court is not inclined to grant bail to the petitioners.
