THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.5743 of 2019 ORDER:

This Criminal Petition under Section 482 of Cr.P.C., is filed by the petitioners/A1,A2, A3 and A7 seeking to quash the proceedings in C.C.No.110 of 2018 on the file of the IX Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, registered for the offences under Sections 406, 420, 506 read with Section 34 IPC, against them.

Heard learned counsel for the petitioners, learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Though the petitioners have raised several grounds to quash the proceedings in the aforesaid case, learned counsel for the petitioners requested this Court to dispense with the appearance of the petitioners in the aforesaid case before the trial Court. 4.

Learned Additional Public Prosecutor contends that the presence of petitioners/A1 and A2 may not be dispensed with as they are prime accused in the crime.

In view of the aforesaid submissions, the appearance of the petitioners/A3 and A7 in C.C.No.110 of 2018 on the file of the IX Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, is dispensed with, except on the dates whenever their presence is required by the trial Court and they shall be represented by their counsel.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
