THE HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5002 of 2015 ORDER:

The petitioner/A.2 seeks for relaxation of the conditions imposed by the Special Judge for Economic Offences, Hyderabad, in Crl.M.P.No.1873 of 2002 dated 19.07.2002 while granting anticipatory bail to him. Heard Smt. G.Bhanupriya, the learned Counsel for the petitioner and Sri P.Kesava Rao, the Special Public Prosecutor for CBI representing State-respondent before admission and perused the material on record. The learned counsel for the petitioner submits that the condition imposed by the Trial Court may be relaxed for a period of two months to enable the petitioner to go out of India to perform pilgrimage and return to India. He would further submit that the petitioner has been permitted every year to go over to Makka in pilgrimage during Ramzan season. Needless to say many a time such a concession to go to Makka for pilgrimage is given, including in the previous year by order dated 17.06.2014 in Crl.P.No.2014 with conditions.

In view of the above submission, this Court inclined to consider to that effect. Accordingly, the Criminal Petition is allowed, and the condition imposed by the Trial Court, through order dated 19.07.2002 in Crl.M.P.No.1873 of 2002, is hereby relaxed for two months by permitting the petitioner to leave the country by obtaining necessary VISA by taking back the passport from the learned Magistrate subject to execution of a bond on a stamp paper worth of Rs.100/- a security worth for Rs.50,000/- by cash or F.D.R. or immovable property with title deed deposit with undertaking to appear and resubmit the passport. For any non-compliance, the security or its value by realisation, will be forfeited. ______________________
