THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.11674 OF 2016 O R D E R :
Heard counsel for the petitioner and the Government Pleader for Revenue appearing for the respondents.
2. Petitioners' grievance is that they are the owners of the subject land; that they intended to sell the said land to some third party; but the 5th respondent is not receiving the document for the purpose of registration.
3. The Government Pleader for Revenue appearing for respondents states that the 5th respondent would receive the document presented by the petitioners and if the 4th respondent does not wish to register it, he will pass orders under Section 71 of the Registration Act, 1908 (for short 'the Act') giving reasons why he does not wish to register the said document.
4. In view of the said submission, the Writ Petition is disposed of directing the 5th respondent to receive the document presented by the petitioners and if the 5th respondent does not wish to register it, he shall pass an order, why he does not wish to register, under Section 71 of the Act within a period of eight (08) weeks thereafter and communicate his decision thereon to the petitioners. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
