HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.27838 of 2005 ORDER :

When the matter is taken up for hearing, learned counsel for the petitioners contends that the petitioners have filed this writ petition seeking promotion to the post of Charge Hand (Electrical).

Learned counsel for the petitioners contends that though the petitioners are fully qualified and eligible to be promoted as Charge Hand (Electrical), the respondents are not considering their cases for promotion to the post of Charge Hand (Electrical). The learned counsel, therefore, contends that appropriate orders be passed directing the respondents to consider the cases of the petitioners for promotion to the post of Charge Hand (Electrical) in accordance with the Rules and pass appropriate orders.

The learned Standing Counsel for the respondents Company contends that the petitioners have not passed the required Test for promotion to the post of Charge Hand (Electrical) and hence their cases were not considered for promotion to the said post. The learned Standing Counsel further contends that the cases of the petitioners will be considered for promotion to the post of Charge Hand (Electrical) in accordance with the Rules, subject to the petitioners

AKS, J W.P.No.27838 of 2005 qualifying the Test for promotion to the said post and appropriate orders would be passed in accordance with law. Having considered the rival submissions of the learned counsel for the respective parties, this Court is of the considered view that this writ petition can be disposed of directing the respondents to consider the cases of the petitioners for promotion to the post of Charge Hand (Electrical), if they are otherwise eligible and qualified, in accordance with the Rules and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above observations, this writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
