HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.34148 OF 2017 O R D E R :

The case of the petitioner is that he was appointed as Home Guard vide orders No.06/R1-AR/HG/RR/09 (D.O.No.19/09), dated 06.01.2009 by the 3rd respondent and completed two years of service as Home Guard. While so the petitioner was implicated in a criminal case on the allegation that he harassed his wife physically and mentally and on such allegation a complaint has been registered against the petitioner before Pargi Police Station and basing on the said complaint the police registered a case in Cr.No.10/2007 under Section 498-A and 302 R/w 149 of IPC. On the ground that the petitioner was involved in a criminal case, and was under judicial custody for more than 48 hours, the respondent authorities not allowed the petitioner to discharge his duties. In the mean time criminal case registered is against the petitioner in S.C.No.

122 of 2011 and the Court of XII Additional District and Sessions Judge, Vikarabad, R.R.District acquitted the petitioner by Judgment dated 21.04.2016. After acquittal, the petitioner approached the 3rd respondent number of times to consider the his claim for admitting him into duties. Even after passing of one year there is no response from the authorities. Aggrieved by the same present writ petition is filed.

Heard learned counsel for the petitioner who submits that this Court in identical case in WP(TR) 173/2017 passed orders allowing the same.

Heard learned Assistant Government Pleader for Services.

Since the grievance of the petitioner is already pending before the respondent authorities by way of representation dated 02.08.2017, it is for the authorities to consider the same and pass orders.

In view of the same, without expressing any opinion on merits, the writ petition is disposed of with a direction to the competent authority to consider the representation of the petitioner keeping in view the orders passed by this Court in WP(TR) No.173/2017, within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.
