HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO CIVIL REVISION PETITION Nos. 3662, 3680 and 3932 of 2015 COMMON ORDER:
These three Civil Revision Petitions are filed by the defendant against the identical orders passed in three different suits at the instance of the respondent/plaintiff who filed interlocutory applications seeking to receive documents and recall him as P.W.1. The said applications were allowed by the Court below through separate orders. Though the present Civil Revision Petitions are filed in the month of August, 2015, in view of non taking up of the
matters till 11.09.2015, the orders passed by the trial Court were carried out and P.W.1 marked the documents. Now the suits are coming up for arguments of the petitioner/defendant.
The petitioner/defendant filed the present Civil Revision Petitions against those orders which have already been worked out. Even otherwise on merits also, the present applications were filed after the P.W.1 was cross examined a n d since the suits are for recovery of money, burden is on the respondent/plaintiff to adduce necessary evidence to prove the claim. The Court below has taken this fact into consideration and passed orders exercising its discretion in allowing the respondent/plaintiff to mark certain documents. This Court having carefully gone through the material on record is disinclined to interfere with the orders under revision.
Inasmuch as the impugned orders have already been worked out and even otherwise on merits also, the Civil Revision Petitions are liable to be dismissed. Accordingly, the Civil Revision Petitions are dismissed. Miscellaneous petitions pending consideration if any in these Civil Revision Petitions shall stand closed in consequence. No order as to costs.
